
The Central Board of Indirect Taxes & Customs (CBIC), under the Department of Revenue, Ministry of Finance, Government of India, has issued comprehensive instructions for effective monitoring and timely review of ongoing court cases relating to service matters of officers under CBIC. The instructions have been issued vide F. No. C-50/94/2024-Ad.II, dated 9th June, 2026, with a view to ensuring that the interests of the Department are adequately represented before all judicial forums.
As per the directive (F. No. C-50/94/2024-Ad.II), all field formations, including the concerned Division in the Board, are required to obtain a Note on the Proceedings of the Court (NoP) from the Government Counsel on the date of each hearing. The NoP must be obtained by the evening of the hearing date and submitted to the concerned senior officers for perusal. Further, a copy of the NoP shall also be emailed to the concerned Division in the Board on the following working day, without fail.
The Note on the Proceedings of the Court (NoP) is required to contain the following key details: (i) significant observations made by the Hon’ble Court during the hearing; (ii) directions, if any, issued by the Hon’ble Court; (iii) the next date of hearing; (iv) specific requirements, documents, inputs, or clarifications needed by the Learned Counsel for effective representation of the Department’s case; and (v) suggestions, if any, of the Learned Counsel regarding the further course of action to be taken by the Department.
The directive further provides that any important development or issue requiring immediate attention of the Department shall be specifically highlighted in the NoP to facilitate prompt action. CBIC has additionally requested that necessary instructions be issued to all Government Counsels concerned to invariably furnish the Note on the Proceedings of the Court on the same day as the hearing.
Compliance with these instructions has been directed to be scrupulous, and any deviation therefrom shall be viewed seriously. The directive is addressed to all Principal Chief Commissioners, Principal Director Generals, Chief Commissioners, and Director Generals of Central Board of Indirect Taxes & Customs, as well as all Divisions under CBIC.
