Unichem Laboratories receives ₹94 crore GST order over penalty, interest

Mumbai-based pharma company Unichem Laboratories Ltd on Saturday (September 19) said it has received an Order-in-Appeal from the Commissioner (Appeals), Thane, involving a total of ₹93.66 crore in penalty and interest liability in a case related to the cross-charge of common services.

The amount comprises a ₹87 crore penalty under Section 74(1) and Section 122(2)(b) of the Central Goods and Services Tax (CGST) Act, 2017, and an interest liability of ₹6.58 crore. The order was received on September 18, 2026, after 2 pm.

The case relates to alleged delayed payment of tax liability for supplies after the time of supply, in contravention of Section 13 of the CGST Act, 2017 and Rule 47 of the CGST Rules, 2017, resulting in the interest liability. The penalty also refers to the corresponding section of the Maharashtra Goods and Services Tax Act, 2017.

Unichem Laboratories said there will be no material impact on its financial, operational or other activities. The company, based on legal advice, will take appropriate steps, including filing an appeal against the order within the prescribed timelines.

Back in February, Unichem Laboratories said the US Food and Drug Administration (USFDA) conducted an inspection at its Kolhapur active pharmaceutical ingredients (API) manufacturing facility.

The inspection, carried out between January 27 and February 2, was closed with five observations. The company clarified that all observations relate to procedural aspects and are not linked to data integrity concerns.

In an exchange filing, Unichem said it will submit its response to the USFDA within the stipulated 15-day timeframe.
