Income Tax Audit: Bhilwara Tax Bar Association moves Rajasthan HC seeking deadline extension

The Bhilwara Tax Bar Association has filed a writ petition in the Rajasthan High Court under Article 226 of the Constitution, seeking an extension of the September 30 deadline for filing Tax Audit Reports (TAR) for assessment year 2025-26.

The petition cites principles of natural justice, equity, and fair play, arguing that taxpayers and professionals are struggling with persistent glitches on the income tax portal, delayed release of ITR forms, and limited working days ahead of the festive season. Several regions in India have also been hit by heavy rainfall and floods, further affecting compliance efforts, the petition claims.

The Bhilwara Tax Bar Association is not the only body seeking extension of the audit deadline. Multiple tax bodies, including chambers of commerce and the Institute of Chartered Accountants of India (ICAI), have also urged the Finance Ministry to grant more time. ICAI formally requested a two-month extension on September 19. They highlight the need for adequate time between non-audit ITR filing and TAR submission.

Tax professionals have also taken to social media platform X to campaign for an extension. The Income Tax Department has yet to respond, though deadline relaxations have been granted in similar circumstances in the past.
