
The Government of India, through the Directorate General of Foreign Trade (DGFT), has issued a significant notification amending the import policy conditions for Glufosinate and its salts under Chapter 38 of Schedule-I (Import Policy) of ITC (HS) 2022. The amendment aims to regulate imports and safeguard domestic interests by imposing price-based restrictions.
As per Notification No. 10/2026-27 dated April 13, 2026, issued under the provisions of the Foreign Trade (Development & Regulation) Act, 1992 read with the Foreign Trade Policy (FTP) 2023, the Central Government has revised the import policy conditions for specified ITC (HS) codes. The amendment will remain in force for a period of six months from the date of publication of the notification.
The revised policy retains the classification of imports as “Free”; however, it introduces a critical restriction linked to import pricing. Specifically, the import of Glufosinate and its salts shall be treated as “Restricted” in cases where the combined value of Cost, Insurance, and Freight (CIF) along with applicable anti-dumping duty, calculated on a per kilogram basis, is less than INR 1,154 per kg. This measure is intended to curb low-priced imports that may adversely impact domestic manufacturers.
The notification, as detailed in the tables across pages 1 to 3 of the document, covers multiple ITC (HS) codes including 38089193, 38089199, 38089361, 38089391, 38089399, 38089912, 38089991, and 38089999. For all these categories, the revised policy condition mandates adherence to Policy Condition No. 07 of Chapter 38, along with the newly introduced price-based restriction.
Additionally, in the case of pesticide-related imports, the notification reiterates the requirement of registration under the Central Insecticides Board and Registration Committee (CIB&RC) under the Ministry of Agriculture & Farmers Welfare, along with compliance under the Insecticides Act, 1968, as highlighted in page 2 of the notification. This ensures regulatory oversight on quality and safety aspects of such imports.
The effect of the notification, as summarized on page 4, clearly states that imports of Glufosinate and its salts falling under the specified HS codes will be subject to restriction if the import price falls below the prescribed threshold of INR 1,154 per kg. This condition will be applicable for six months, after which the policy may be reviewed.
This notification has been issued with the approval of the Minister of Commerce & Industry and reflects the Government’s continued efforts to ensure fair trade practices, prevent dumping, and maintain a level playing field for domestic industry.
