Collection of Anti-Dumping Duty on Titanium Dioxide Imports from China PR Stopped Following High Court Order

The Central Board of Indirect Taxes and Customs (CBIC) has issued Instruction No. 33/2025-Customs dated December 05, 2025, directing all field formations to stop the collection of anti-dumping duty on imports of Titanium Dioxide originating in or exported from China PR.

The direction follows the order of the Hon’ble High Court at Calcutta dated 22 September 2025 in the matter of India Paint Association vs Union of India & Ors (WPO 148 of 2025), wherein the Court quashed Notification No. 12/2025-Customs (ADD) dated 10 May 2025 that had imposed anti-dumping duty on Titanium Dioxide from China PR.

In compliance with the judgment, CBIC has instructed all Principal Chief Commissioners, Chief Commissioners, Principal Commissioners, Commissioners of Customs, and Director Generals under CBIC to cease collection of anti-dumping duty on the referred goods with immediate effect.

This instruction has been circulated to ensure uniformity in implementation and adherence to the directions of the Hon’ble High Court.
