In a significant move to strengthen transparency, accountability and adherence to the principles of natural justice in GST proceedings, the Government of NCT of Delhi, Department of Trade & Taxes, vide Circular bearing F. No. F.3(666)/GST/P&R/2026/347 dated October 14, 2026, has issued strict directions to all Proper Officers to ensure that Show Cause Notices (SCNs) and adjudication orders are clear, comprehensive, evidence-based and legally sustainable.
Vague and Template-Based Show Cause Notices to Be Avoided: The Department has emphasised that every Show Cause Notice must clearly specify the material facts, nature of the alleged contravention, relevant statutory provisions, supporting evidence and proposed action. Allegations must be specific, based on available records and sufficiently detailed to enable taxpayers to submit an effective defence. Generic, vague or mechanically issued template-based notices lacking case-specific reasoning should be avoided.
Speaking and Reasoned Orders Mandatory: The Circular further directs Proper Officers to ensure that final adjudication orders reflect proper application of mind, appreciation of facts and evidence, consideration of taxpayers’ submissions and clear legal reasoning supporting the conclusions reached. The Department has reiterated that inadequately reasoned notices and orders may undermine the sustainability of GST proceedings and lead to avoidable litigation.
Retrospective Cancellation of GST Registration Requires Specific Justification: Particular emphasis has been placed on cancellation of GST registration with retrospective effect under Section 29(2) of the GST Act. The Department has clarified that although retrospective cancellation is legally permissible in appropriate cases, such action must be supported by cogent reasons and objective material available on record. The proposed retrospective date, along with the justification for selecting that date, must be clearly disclosed in the SCN. The final cancellation order must also record specific reasons warranting such retrospective effect.
Strict Adherence to Principles of Natural Justice: All Proper Officers have been instructed to scrupulously comply with statutory requirements, applicable judicial pronouncements and principles of natural justice while conducting adjudication and registration-related proceedings. The directions are intended to ensure that taxpayers receive a meaningful opportunity to respond to allegations and that departmental decisions are supported by facts and law.
Zonal Authorities Made Responsible for Monitoring Compliance: The Department has directed all Zonal Authorities to ensure effective dissemination of these instructions and closely monitor their implementation within their respective jurisdictions. The directions apply to adjudication as well as GST registration-related proceedings.
Strict Administrative and Disciplinary Action for Non-Compliance: Significantly, the Circular provides that these instructions shall be followed strictly and with immediate effect. Any deviation or non-compliance will be viewed seriously, and strict administrative or disciplinary action, as warranted under the applicable rules, shall be initiated against the concerned officers, including Zonal In-charges.
Significant Implications for GST Taxpayers and Administration: The Circular reinforces the importance of procedural fairness, reasoned adjudication and accountability in GST administration. By specifically discouraging vague SCNs and unreasoned orders and requiring objective justification for retrospective registration cancellation, the directions are expected to strengthen taxpayer protections, improve the quality of departmental proceedings and help minimise avoidable GST litigation.
Key Takeaway: GST proceedings must be based on specific allegations, supporting evidence and reasoned decisions. Retrospective cancellation of GST registration cannot be justified merely through generic observations; the proposed retrospective date must be supported by cogent reasons and objective material. Non-compliance with these directions may invite disciplinary action against the concerned GST officers, including Zonal In-charges.
