
Uttarakhand tax department has recovered Rs 2.25 crore from Eden Senior Living & Wellness, a private real estate and wellness company operating an assisted-living facility for senior citizens, after alleged irregularities were detected in the payment of GST on flat sales, officials said.
Special Investigation Branch (SIB) of the department inspected the company’s premises on Thursday, with the survey continuing on Friday. Officials said the company had discharged its GST liability on the sale of flats by using input tax credit (ITC) claimed on construction-related purchases, instead of paying the liability in cash.
The department assessed the company’s total tax liability at Rs 12.50 crore, following which the company deposited Rs 2.25 crore in the state exchequer and its directors sought time to pay the remaining amount.
Deputy commissioner Suresh Kumar told TOI that the company was not legally permitted to use ITC for the liability in question. “To substantiate the irregularities, the investigating team collected documents, forms and information from Real Estate Regulatory Authority (RERA), Mussoorie Dehradun Development Authority (MDDA), district magistrate’s office, mining section and other departments,” Kumar said, adding that the team also seized records relating to the company’s business activities.
Based on an analysis of data available on the GST portal and the documents collected during the inspection, the company’s directors, legal advisers and other representatives present during the investigation admitted to the tax-payment error, Kumar said.
The investigation team included deputy commissioner Suresh Kumar, assistant commissioner Krishna Kumar and officials TR Chinyal, Alisha Bisht, Kanchan Thapa and Asad Ahmed.
Eden Senior Living and Wellness, located in Purkul, offers studio, one-bedroom and two-bedroom apartments for senior citizens.
