Draft of bill to amend Maharashtra Goods and Services Tax Act, 2017 to be introduced in monsoon session of legislature

The draft of the bill to amend the Maharashtra Goods and Services Tax Act, 2017, will be introduced in the upcoming monsoon session of the legislature. The amendments were approved in the state cabinet on Tuesday. The central govt has made changes in various sections and Schedule 3 of the Central Goods and Services Tax Act 2017. Recommendations for this were made in the 55th meeting of the GST Council. Accordingly, the central govt passed the Finance Act 2025 on 29 March 2025. In this context, it was necessary to make amendments in the Maharashtra GST Act 2017 to maintain consistency and practicability in the provisions of the Central GST Act 2017 and the Maharashtra GST Act 2017, officials said.

The Maharashtra Settlement of Arrears of Tax, Interest, Penalty or Late Fee (Payable by Public Sector Undertakings) (Amendment) Bill, 2025, was approved in the state cabinet to be tabled in the state legislature’s monsoon session too. The Maharashtra Settlement of Arrears of Tax, Interest, Penalty or Late Fee (Payable by Public Sector Undertakings) Act, 2025, has been implemented from 21 March 2025 to recover arrears under various acts from the GST department. As per the provisions of this Act, the period for settlement of arrears is from 21 March to 31 December 2025. The definition of applicant in this Act will be amended. This will include public sector companies, public sector banks, or govt institutions, departments, authorities, corporations, rural and urban local bodies which are not registered under the Companies Act 2013 but are established by the legislature of the Centre or any State or Union Territory or by a govt resolution, officials said.

This will close the old pending recovery cases by paying the settlement amount, and this will result in the govt receiving revenue that was pending for a long time. For this, the state govt approved the introduction of the Settlement of Arrears of Tax, Interest, Penalty or Late Fee (Payable by Public Sector Undertakings) (Amendment) Bill and its draft, officials said.
